BACKGROUND/SUMMARY:

All County Departments have submitted their Position Requests, Capital Improvement Project (CIP), and Fixed Asset requests to the County Administration Office (CAO). The attached presentation provides recommendation to the positions, capital projects and road infrastructure projects for the upcoming fiscal year.

 

Positions

For Fiscal Year 2022-2023, the County Administration Office received request to add a total of 28 new positions to the budget. Twenty three of the positions were requested by the General Fund Departments and five positions were requested by the Subvention funds.

 

General Fund - Total Ask = $2,108,758.03

 

Subvention Funds - Total Ask = $444,209.00

 

 

Capital Projects

For Fiscal Year 2022-2023, the County Administration Office (CAO) and Resource Management Agency (RMA) received 9 new General Fund Projects, and also have 17 projects which will roll over from the prior fiscal year. For Subvention/Department funded there where 8 new projects requested for the new year and 6 projects which will roll from this year to the next fiscal year. All of these projects were presented on May 4th 2022, Capital Facilities Committee which provided direction to the CAO and RMA offices on priorities for the next fiscal year. The following are the recommendations from that Committee.

Public Defender

The Public Defenders represent individuals accused of crimes or involved in probate, conservatorships, and limited civil matters appointed by the court to defendants who cannot afford to hire an attorney. The County contracts out public defender services. 

 

San Benito County currently contracts out with three levels of attorneys:

 

  1. Fitzgerald, Alvarez and Ciummo, Level 1 - Three year contract
  2. Harry Damkar, Level 2 - One year contract
  3. Pamela Brown, Level 3 - One year contract

 

The as covered above the Fitzgerald, Alvarez and Ciummo contract is a multi year contract with a 1.5% cost of living adjust (COLA) for each year after the fist year. This is the only contract which has the COLA and now that Harry Damkar and Pamela Brown's contracts are up for renewal, the Board of Supervisors is being brought into the discussion to provide some direction for the new contract negotiations with Harry Damkar and Pamela Brown.

   

Appropriations (GANN) Limit

On November 1979, California voters approved Proposition four, “The Gann Initiative” which is incorporated Article XIIIB of the California State Constitution. Proposition four limits the amount of tax revenue that State and local government agencies can appropriate. A jurisdiction’s annual appropriations limit is calculated based upon the level of appropriations in fiscal year 1979 and subsequent changes in the local population and cost of living.

 

California Revenue and Taxation Code section 2227 requires the Department of Finance to transmit an estimate of the percentage change in population to local governments. Each local jurisdiction must use their percentage change in population factor for January 1, 2022, in conjunction with a change in the cost of living, or price factor, to calculate their appropriations limit for fiscal year 2022-23. The population percentage change data excludes federal and state institutionalized populations and military populations.

 

The Board of Supervisors previously adopted the County's GANN limit for fiscal year 2021-2022 during last year's special budget meeting calculated at $43,299,018. The new GANN limit for fiscal year 2022-23 is $46,428,390 (resolution and GANN limit calculation schedules are attached to this agenda item).

Public Defender

The County issued an RFP in November 2020, with an initial closing date of December 18, 2020.  This was subsequently extended to January 21, 2021, and then finally to February 11, 2021 in order to ensure adequate outreach and publication of the proposal. The County received a total of 7 responses (by way of proposals received) and 1 additional inquiry that ultimately did not submit a proposal. 

 

On March 23, 2022 the Board of Supervisors approved contracts for three levels of Public Defender as follows:

 

  • Fitzgerald, Alvarez and Ciummo, Level 1 - Three year contract
  • Harry Damkar, Level 2 - One year contract
  • Pamela Brown, Level 3 - One year contract
