Adopt Resolution for Exception to the 180-Day Wait Period Government Code Sections 7522.56 & 21224 and authorize the employment of Karen Overstreet as an extra help retired annuitant to perform the duties of the Agricultural Commissioner/Sealer of Weights and Measures for the County of San Benito in accordance with Government Code section 21224, effective May 5, 2022.

BACKGROUND/SUMMARY:
The California Food and Agricultural Code requires that counties have a licensed Agricultural Commissioner/Sealer of Weights and Measures to exercise the powers and duties as regulated. The acting Commissioner does not hold the required license.
The County is currently recruiting to fill the Agricultural Commissioner/ Sealer of Weights and Measures position with an appropriately licensed official. The request to hire an Extra Help Retired Annuitant is temporary until the position has been filled. The temporary position will ensure all required budgets and contract work plans are completed and signed by a licensed official as required by law.
The County previously made a similar arrangement after the retirement of former Agricultural Commissioner Ron Ross by Resolution No. 2014-109.
Resolution for exempting the 180-Day Waiting Period was previously approved on consent agenda on meeting of April 26, 2022. CalPers has requested to have the resolution approved on regular agenda.
