Adopt Resolution approving property purchase agreement, approving the forms of grant deeds for right of way, a retaining wall easement, and a temporary construction easement for the Union Road Bridge project, authorizing the Interim RMA Director to accept executed grant deeds and easement grants delivered from the San Benito County Water Conservation and Flood Control District, and authorizing payment of $2,500.00 for such purchase.

BACKGROUND/SUMMARY:

The County is acquiring right-of-way, a retaining wall easement, and a temporary construction easement from the San Benito County Water Conservation and Flood Control District (County Water District) for purposes of construction of the Union Road Bridge.  The County negotiated the purchase of real property on a parcel owned by the County Water District (APN 020-280-035).  Due to the small size, the County's appraisal indicated a fair market value below the County's adopted minimum value payment for right-of-way acquisitions ($2,500.00), so the County offered $2,500.00 for the property rights being acquired.

 

The Board of Directors for the County Water District adopted a Resolution (County Water District Resolution 2022-14) at its regular meeting on April 27, 2022, authorizing the District Manager to sign the Property Purchase Agreement and convey the grant deeds and easement grants to the County.  The County Water District has requested that the Board of Supervisors approve the Property Purchase Agreement before the District Manager signs and delivers the grant deeds and easement grants.  Given the short time-frame to complete Caltrans' right-of-way certification process, the grant deeds and easement grants are presented for the Board's approval as to form, with a request that the Board authorize the Interim RMA Director to accept the grant deeds and easement grants on behalf of the County as soon as the County Water District delivers fully executed grant deeds and easement grants on the approved form, so that the Interim RMA Director can deposit them immediately into escrow for expedited processing.

 

Resolution No. 2022-__, approving a property purchase agreement, approving the forms of grant deeds for right of way, a retaining wall easement, and a temporary construction easement for the Union Road Bridge project, authorizing the Interim RMA Director to accept executed grant deeds and easement grants delivered by the County Water District, and authorizing payment of $2,500.00 for such purchase, is presented for the Board's consideration.

STAFF RECOMMENDATION:

1.      Adopt Resolution 2022-55 approving the Property Purchase Agreement reflected in Attachment 1, approving the forms of the grants reflected in Attachments 2 through 4, and authorizing the Interim Resource Management Agency Director to accept the grants for and on behalf of the County of San Benito, upon Grantor’s delivery of the fully executed grants to the County, and authorizing payment of fair market value for the property rights granted from Budget Unit 2102 695, and

 

2.      Authorize and direct the Chair of the Board of Supervisors to execute the Property Purchase Agreement reflected in Attachment 1; and

 

3.      Authorize and direct the Interim Resource Management Agency Director to execute the certifications of acceptance and consent to record the grant deeds and easement grants upon grantor's delivery of the fully executed deeds and easement grants to the County on the forms reflected in Attachments 2 through 4, and to transmit them to the County Recorder's Office for recording; and


4.      Authorize and direct the San Benito County Auditor to issue County warrants to the Grantor, in the amounts reflected in Attachment 1, from Budget Line Item 210.70.2020.1211.650.203.
