BACKGROUND/SUMMARY:
In approving the 90 single-family residential unit development referred to as The Promontory at Ridgemark Development (Tract 353), formerly known as The Bluffs at Ridgemark, (“The Promontory at Ridgemark Development”), the County of San Benito Planning Commission adopted Resolution 2018-3 with Condition of Approval No. 9, requiring The Promontory at Ridgemark Development be annexed into the existing San Benito Geologic Hazard Abatement District (“GHAD”). With the approval of Resolution No. 2022-1, the GHAD Board of Directors (“GHAD Board”) approved annexation of The Promontory at Ridgemark Development into the San Benito GHAD and approved the Plan of Control. To secure a funding source for The Promontory at Ridgemark Development, an Engineer’s Report has been prepared to identify the funding of the GHAD-maintained improvements identified in the Plan of Control. The Engineer’s Report recommends an assessment limit of $1,332.00 per single family residential unit (Fiscal Year 2021/22 dollars).
On May 10, 2016, the San Benito County Board of Supervisors adopted Resolution No. 2016-31 approving the formation of the San Benito GHAD and appointed the members of the San Benito County Board of Supervisors to serve as the GHAD Board of Directors. On January 25, 2022, the GHAD Board of Directors held a public hearing on the proposed annexation of The Promontory at Ridgemark Development into the San Benito GHAD and adopted Resolution 2022-01 approving the annexation of The Promontory at Ridgemark Development into the San Benito GHAD and accepting The Promontory at Ridgemark Development Plan of Control.
The funding source for the GHAD operations within The Promontory at Ridgemark Development is a real property assessment on the residential properties within The Promontory at Ridgemark Development. This assessment for the 90 single-family residential units within The Promontory at Ridgemark Development is proposed to be imposed at the time building permits are issued for the residential units. The assessment is proposed to maintain the improvements in The Promontory at Ridgemark Development Plan of Control previously approved by the GHAD Board on January 25, 2022 (Resolution No. 2022-1).
The proposed assessment is supported by the attached Engineer’s Report prepared by a registered professional engineer certified by the State of California, in accordance with Proposition 218 (attached as Attachment 1 to Resolution No. 2022-2). The Engineer’s Report recommends an assessment limit of $1,332.00 per each single family residential unit (Fiscal Year 2021/22 dollars). The annual assessment limit would be adjusted annually based on the San Francisco-Oakland-Hayward Consumer Price Index (CPI).
To allow the GHAD Board to consider approval of the proposed assessment, the property owner of The Promontory at Ridgemark Development will be provided with a copy of the Engineer’s Report, a Notice of Intent to Order an Assessment, and a ballot (Resolution 2022-2) following this meeting.
