Delegate authority to the Chief Probation Officer or designee to finalize and execute a Memorandum of Understanding (MOU) for Senate Bill 129 (SB 129) Pretrial Program between the San Benito County Probation Department and the Superior Court of California San Benito County, subject to County Counsel's approval as to legal form, approve hiring one (1) F.T.E. Deputy Probation Officer and one (1) F.T.E. Probation Aide and direct staff to amend the schedule of authorized positions, and approve a Budget Adjustment of $203,349.00 to accommodate the staffing costs, which are fully funded by the Superior Court of California San Benito County. BACKGROUND/SUMMARY:
Senate Bill 129 (Stats. 2021, ch. 69) amending the Budget Act of 2021, provides funding for the development of the Pretrial Program to implement, operate, and evaluate pretrial decision-making. The Court will subcontract with the County through the Probation Department to provide pretrial services, to complete the program objectives through reimbursement of the SB 129 Pretrial One-Time Funding and Pretrial Ongoing Funding.
Senate Bill 129, the goals of this Pretrial Program are to:
1. Provide "the implementation and operation of ongoing court programs and practices that promote the safe, efficient, fair, and timely pretrial release of individuals booked into jail."
2. Implement monitoring practices of those released pre-arraignment and pretrial with the least restrictive interventions and practices necessary to enhance public safety and return to court.
Courts are required to contract for pretrial services with their county's probation department or any county department other than departments of agencies that have primary responsibility for making arrests or prosecuting criminal offenses per SB 129.
In order to achieve SB 129 Pretrial Program goals, the Probation Department will need to staff the positions as appropriate to provide pretrial services to complete the program objectives. Both positions will be fully funded by the SB 129 Pretrial Program Funds.
