BACKGROUND/SUMMARY:
On June 28, 2021, an administrative hearing was held regarding code violations on the real property located at 2594 Los Viboras Road. On July 26, 2021, the hearing officer issued their recommended decision, detailing the background and circumstances at issue. (See Attachment 1.)
The hearing officer's decision provides in its relevant parts that:
- The County had proved the existence of the violations;
- The County's proposed administrative penalties were reasonable;
- The Owner is ordered to immediately take abatement action; and
- The County is permitted to record the Notice against title to the property.
Per San Benito County Code section 1.06.110, this recommended decision is being presented to the Board of Supervisors, who may adopt the recommendation without further notice of hearing, or may set the matter for a de novo hearing before the Board of Supervisors.
This matter is being presented to the Board of Supervisors to confirm the action taken at a prior meeting, but, as the County recently updated its Municipal Code provisions regarding code enforcement, this resolution is in a new form.
