Home Occupation and Rural Home Enterprise Ordinance Amendments-Proposed amendments include repeal existing sections 25.29.090 to 25.29.104 in their entirety and replace with the following.

BACKGROUND/SUMMARY:

Public Hearing to review and adopt proposed amendments to the Home Occupation and Rural Home Enterprise San Benito County Code include repeal existing sections 25.29.090 to 25.29.104 in their entirety and replace with the following. There were not any significant changes to the Home Occupation sections but was rather reorganized for better clarity into the following sections: Home Occupations Defined, Permitted Zoning Districts, Permits Required, Regulations, Permitted Home Occupations, Prohibited Home Occupations, and Signs.

 

The Rural Home Enterprise sections were also reorganized into the same categories as Home Occupations and simplified for clarity, except since Rural Home Enterprise require either an Administrative Permit it also includes sections of Filing Requirements, Permit Review and Findings, and Permit Modification or Revocation. The main changes to the Rural Home Enterprise include allowing up to (5) on-site employees and amending the time of operation between 8 a.m. and 6 p.m. weekdays (existing County Code has between 8 a.m. to 9 p.m. and does not specify days). Planning Commission recommended a stricter hour of operation to existing County Code due to comments received from the public. There had been a change to remove the 5-acre minimum, but Planning Commission recommended leaving that in, so no changes were done to existing County Code.

STAFF RECOMMENDATION:

Staff respectfully recommends that the Board of Supervisors:

 

1. Receive and consider Planning Commission Resolution recommending adoption of Ordinance amendments;

 

2.  Conduct a public hearing on the adoption of the proposed Ordinance amendments;

 

3.  Adopt the attached proposed ordinance provisions to delete Sections 25.29.090 to 25.29.104 in their entirety and replace with the attached Sections 25.29.090 to 25.39.105, related to Home Occupations and Rural Home Enterprises within San Benito County.

 

4. Direct staff to publish a post-adoption summary of the ordinance and file a Notice of Exemption with the County Clerk and CEQA Clearinghouse.
