BACKGROUND/SUMMARY:
The County of San Benito, City of Hollister, and San Benito High School District entered into an Interagency agreement on November 21, 2016, to work collaboratively on the County’s Regional Park project and closure of Nash Road between West Street and Monterey Street, to make the High School crossings on Nash Road safer for students and faculty. The County operates the southern half of that portion of Nash Road, and the City operates the northern half. The agreement temporarily closed Nash Road during the school year from 7:00 am to 7:00 pm, Monday through Friday. As part of the agreement, the San Benito High School District would enter into a 99-year lease with the County for the County Regional Park. Upon permanent closure of Nash Road, would transfer fee title to the County. The parties entered into Amendment #1 to the Interagency Cooperation Agreement on or about October 5, 2017.
This Term Sheet for Interagency Property Exchange dated July 31, 2020) addresses vital terms and conditions to execute the property exchange between the San Benito High School District, the County of San Benito, and the City of Hollister. The term sheet provides the framework for the permanent closure by the City of Hollister and the County of San Benito, for a portion of Nash Road between West Street and Monterey Road (“Nash Road Closure Area”) and the deeding of fee interests or property rights therein to San Benito High School District, in exchange for the fee simple transfer of the Regional Park Property to the County of San Benito for the development of a regional park.

1. Accept the Term Sheet for Interagency Property Exchange with San Benito High School District (SBHSD) and City of Hollister relating to the terms and conditions to permanently close, vacate and dispose of a portion of Nash Road between West Street and Monterey Street, and disposition of SBHSD land to execute a property exchange, noting that the final agreement to be drafted will be based on these terms;
2. Authorize the County Administrative Officer to negotiate the Exchange Agreement, based on these basic terms, noting that agreement will be finalized and returned to the Board for final approval in the upcoming weeks.
