In regard to the initiative to create the Strada Verde Innovation Park Specific Plan (1) consider whether to adopt the initiative measure without alteration within 10 days after the 9111 report is presented, which would require continuation of this item to the 8/4/2020 agenda, or (2) adopt a resolution to submit the initiative measure without alteration to the voters at the next regularly scheduled statewide election occurring not less than 88 days after the order of election.

BACKGROUND/SUMMARY:

Recommendation:

 

With respect to the initiative, it is recommended that the Board:

Consider whether to:

 

(1) Adopt the initiative measure without alteration within 10 days after the 9111 report is presented.  If desired, the Board should continue to the 8/4/20 meeting to receive additional relevant information relating to the adoption of the proposed initiative, or,

 

(2) Adopt the attached resolution to submit the initiative measure without alteration to the voters at the next regularly scheduled statewide election occurring not less than 88 days after the order of election. 

 

SUMMARY:

 

On today's date, the Board of Supervisors received the Registrar of Voters' certification that the initiative petition contained a sufficient number of valid signatures. 

 

During the circulation period, the Board had previously ordered that a report pursuant to Elections Code section 9111 be prepared, completed and presented to the Board for consideration.   Pursuant to law, the Board must either (1) adopt the initiative measure without alteration, or (2) submit t6he initiative measure without alteration to the voters at the next regularly scheduled statewide election occurring not less than 88 days after the order of election.

 

DISCUSSION:

 

An initiative was circulated in the County and filed with the County Clerk/Registrar of Voters on June 29, 2020.  On July 14, 2020, the Registrar of Voters certified that the initiative petition had been signed by a sufficient number of voters as provided by Elections Code section 9107 and 9115, and the County Clerk/Registrar of Voter's certification was has been presented to the Board on today's date, and approved prior to action on this agenda item.

 

Following receipt and consideration of the report and pursuant to Elections Code section 9118, the Board of Supervisors now options with respect to the initiative petition:

 

(1) The Board may adopt the initiative measure without alteration within 10 days after the 9111 report is presented; or

(2) The Board may submit the initiative measure, without alteration, to the voters at the next regularly scheduled statewide election occurring not less than 88 days after the order of election.  The next regularly scheduled statewide election not less than 88 days from today's date is November 3, 2020.

FINANCING

 

The Registrar of Voters estimates that the additional cost to place the initiative measure on the election of November 3, 2020 would be approximately $5,000-$15,000.
