Discuss and provide direction to staff regarding the process which should be followed for the negotiation of a project specific (or master) Tax Agreement with the City of Hollister related to commercial annexations.

BACKGROUND/SUMMARY:

In December 2019, the Board of Supervisors approved a new master tax agreement that sets forth how property tax shall be divided between the jurisidctions in the event of a property annexation to the City of Hollister. 

 

The December 2019 MTA did not pertain to commercial annexations.  As such, the  County and the City will either need to enter into a new master tax agreement for commercial annexations, or conduct specific agreements for each specific commercial annexation. 

 

The MTA agreement for residential annexations is attached, but the new tax agreement for commercial annexations will need to contain other terms.

 

This matter is being brought to the Board as there is a project pending before LAFCO that will need a commercial tax sharing agreement, and the annexation cannot be approved by LAFCO before that occurs.

 

The pending annexation is for a cannabis site, known as Briggs 17.

Discuss and provide direction to staff about the processing for moving forward to create a new commercial tax sharing agreement, including but not limited to whether the agreement should be negotiated by staff or whether an ad hoc committee of the Board should be created.
