BACKGROUND/SUMMARY:

On February 4, 2020, the Board of Supervisors adopted Ordinance No. 1003, amending provisions of San Benito County Code Chapter 7.04 relating to Industrial Hemp Entitities.  Through an inadvertant oversight, certain final edits to section 7.04.03 C. and section 7.04.05 D. of the ordinance as adopted. The purpose of this amendment is to correct those omissions to better reflect the final intent of the Board of Supervisors and stakeholder participants in revising hemp regulations in San Benito County to protect the public health, safety, and welfore, and be most consistent with the policies in the 2035 San Benito County General Plan.

STAFF RECOMMENDATION:

Staff recommends that the Board of Supervisors take the following actions:

1. Direct County Counsel to read title of Ordinance;

2. Open public hearing regarding proposed corrective amendments to Hemp Ordinance, Chapter 7.04, of the San Benito County Code;

3. Close the public hearing;

4. Conduct Board of Supervisors deliberations concerning proposed corrective amendments;

5. Entertain motion to adopt ordinance making corrective amendments

6. If ordinance adopted, direct publication and posting of post-adoption summary.
