Conduct a public hearing to consider the Planning Commission recommendation and the adoption of an ordinance to amend the zoning map for an approximately two-acre portion of Assessor's Parcel 020-330-042 located at 151 Ridgemark Drive, 800 feet south of the Airline Highway–Fairview Road–Ridgemark Drive intersection, unincorporated San Benito County, from Single-Family Residential (R1) to Neighborhood Commercial (C-2).

BACKGROUND/SUMMARY:
On December 18, 2019, the County Planning Commission (PC) adopted PC Resolution 2019-30 to approve County Planning file PLN190027 on the condition of consideration and adoption by Board of Supervisors of a zoning map amendment on the subject property. PLN190027 is a proposal for a zone change to establish Neighborhood Commercial (C-2) zoning on approximately two acres and a conditional use permit for 9,990 square feet of commercial floor area on that site. A draft ordinance is attached that would enact this rezoning.
The subject property is adjacent to an existing 2.43-acre area of C-2 zoning, established in 2010 by County Ordinance 859. In 2011, that area was approved for 19,500 square feet of commercial space that was not built. In 2018, a differently arranged and slightly larger building plan, which included restaurant uses not found in the 2011 proposal, was approved but has not yet been built. The conditional use permit approved on December 18 allows 9,990 square feet of commercial use, mainly neighborhood-serving retail and services but also some restaurant or similar food services. Together with the 2018 approval, just under 30,000 square feet of commercial floor area would be built here.
The 2035 San Benito County General Plan displays a Commercial Neighborhood (CN) land use node in this area. In its resolution, the Planning Commission found that the project does not substantially differ from this General Plan designation and that the General Plan’s environmental impact report (EIR) adequately considers any environmental effects of this current land use proposal. The adopted PC resolution contains an addendum to the General Plan EIR to state this in more detail.

1) Review the attached materials, hold a public hearing, and hear any proponents and opponents of the proposed project.
2) Make a motion to: Accept the introduction, waive first reading, and adopt the attached ordinance to enact the Neighborhood Commercial (C-2) zoning on the subject property as recommended by Planning Commission Resolution 2019-30.
