STAFF RECOMMENDATION:

Staff recommends that the Board of Supervisors confer with legal counsel to review existing facts and circumstances and advice of counsel to decide if there is a significant exposure to litigation against the County to decide whether further closed session is authorized.  If the Board of Supervisors decides further closed session discussion regarding the matter is not authorized, terminate the discussion, and omit the next closed session item  If the Board of Supervisors decides further closed session is authorized, proceed to next closed session item for discussion.
