BACKGROUND/SUMMARY:
The California Building Standards Commission adopts the California building codes with amendments from state agencies every three years. These are found in Title 24 of the California Code of Regulations. This code goes into effect January 1,2020 in for all occupancies in California. The County is allowed to adopt more restrictive code amendments..
If the County does not adopt local amendments, the state codes go into effect without local amendments. One purpose of the ordinance amendments to the San Benito County Code is to change the date reference in the county code of the applicable 2019 edition of the Uniform Building Codes adopted by the state to conform with state law.
Amendments to the construction portion of the codes have to be justified for geologic, topographic or climatic conditions. Amendments to the administrative standards of the code does not require justification or state agency approval.
The process for local adoption of state codes by reference is spelled out beginning with Government Code section 50022.1. After a first reading of the title and summary of the ordinance, and publication twice of a notice of public hearing, and the opportunity for the public to inspect a copy of the codes being adopted at the Clerk of the Board's office upon request, the Board can conduct a public hearing and adopt an ordinance adopting the state codes by reference. The first reading is scheduled for February 4, 2020, for adoption at the February 18, 2020 Board of Supervisors meeting.

STAFF RECOMMENDATION:
Staff respectfully recommends that the Board of Supervisors;
Approve the 2019 Building Codes adoption with local amendments, by taking the following actions:
1. Open the public hearing;
2. Introduce the ordinance by reading the title and waiving further reading;
3. Receive any public testimony from anyone wishing to address the item;
4. Continue the public hearing until the February 18, 2020 Board meeting for final adoption.
