Adopt Resolution authorizing the County Administrative Officer to prepare all necessary documents for the Board of Supervisors' consideration, to permanently close, vacate and dispose of a portion of Nash Road between West Street and Monterey Street, and authorize the County Administrative Officer to negotiate the terms of a shared use agreement with the San Benito High School District for construction and shared use of a parking lot on the High School Campus, connected to the River Parkway Bypass Road, to be funded by the County in the estimated amount not to exceed $301,000.

BACKGROUND/SUMMARY:
The County of San Benito, City of Hollister, and San Benito High School District entered into an Interagency agreement on November 21, 2016, to work collaboratively on the County's Regional Park project and closure of Nash Road between West Street and Monterey Street, to make the High School crossings on Nash Road safer for students and faculty. The County operates the southern half of that portion of Nash Road and the City operates the northern half. The agreement temporarily closed Nash Road during the school year from 7:00 am to 7:00 pm, Monday through Friday. As part of the agreement the San Benito High School District would enter into a 99-year lease with the County for the County Regional Park, and upon permanent closure of Nash Road, would transfer fee title to the County.
The parties entered into Amendment #1 to the Interagency Cooperation Agreement on or about October 5, 2017. As described, Amendment #1 outlined that the District would contribute $497,000 and the County agreed to contribute $1,000,000 for the construction of the River Parkway Bypass Road (3.3.9.1). The $497,000 balance is outstanding.
The High School District is interested in the construction of a shared use parking lot on the High School Campus, to be funded by the County. The shared lot would mutually benefit the High School District and the broader community within the County of San Benito, using High School facilities and the County's Regional Park. The County has applied for a Prop. 68 grant for $301,000 to fund construction of a recycled ADA compliant asphaltic public parking lot. A copy of the grant proposal is attached. The High School District also obtained a proposal from Duran and Venables, Inc., the company currently working on other facilities on the High School Campus, in the amount of $196,500. A copy of the High School District's proposal is attached. Staff requests direction from the Board.

1. Adopt Resolution authorizing the CAO to prepare all necessary documents for the Board of Supervisors' consideration, to permanently close, vacate and dispose of a portion of Nash Road between West Street and Monterey Street, and authorize the Chair to sign it; and
2. Authorize and direct the CAO to negotiate the terms of a shared use agreement with the San Benito High School District for construction and shared use of a parking lot on the High School Campus, connecting to the River Parkway Bypass Road, to be funded by the County in the estimated amount not to exceed $301,000.
