BACKGROUND/SUMMARY:

Currently, the San Benito County Code prevents the relocation of buildings if there are existing code violations at the building.  This prevents the movement of the building, even if the new owner is willing to bring the building up to code.   The ordinance change would allow movement/relocation of buildings with existing code violations as long as there were sufficient guarantee that the building would be rehabilitated after movement. 

 

Old Code:

§ 21.01.092  INITIAL INSPECTION.

   No structure shall be moved from any site to a new site within the county until it is, first inspected by the Building Official or his or her deputy and is approved for the relocation. The structure shall be inspected for building, electrical, plumbing and mechanical code compliance in order to assure minimum code conformance. If the structure does not meet minimum code requirements as determined by the initial inspection, the structure shall not be approved for relocation or reuse.

 

Proposed New Code:

21.01.092  INITIAL INSPECTION.

   No structure shall be moved from any site to a new site within the county until it is, first inspected by the Building Official or his or her deputy and is approved for the relocation. The structure shall be inspected for building, electrical, plumbing and mechanical code compliance in order to assure minimum code conformance. If the structure does not meet minimum code requirements as determined by the initial inspection, the structure shall not be approved for relocation or reuse, except if a bond, letter of credit, or other guarantee acceptable to the RMA director, is provided to the County sufficient to perform  all work necessary to remedy all code violations and a written agreement is entered into with the property owner where the building will be located guaranteeing all work will be performed within 12 months.
