Approve Contract with DAS Systems, Inc. for the Emergency Responder radio System Installation for the San Benito County New Jail Expansion Project, for an amount not to exceed $72,500.00. This contract shall commence on September 15, 2019, and end on November 1, 2019, unless sooner terminated as specified herein.

BACKGROUND/SUMMARY:
The original jail expansion project scope included a complete emergency radio system. Through the bidding process, this portion of the projects scope was removed.
During the construction phase, the system went through a design phase that was just completed on August 8, 2019. The equipment was purchase through a prior approved board agenda item, hence this award is just for the installation.
Now that the design is completed and approved as of August 8th, 2019 the installation is the only outstanding work for completion. The attached proposal states the required scope to meet the manufactures warranty requirements.
Here, if the installation of the radio system for the jail is put out to bid and a different vendor ends up installing the radio system, then there would not be a single party responsible for the proper operation of the radio system. If the system then doesn’t perform properly, the County could end up with a situation where the designer/builder and the new installer each blame the other for any operational problems. Thus, putting the contract out to bid would be undesirable and actually produce a disadvantage in this case. Graydon v. Pasadena Redevelopment Agency, (1980) 104 Cal.App.3d 634
