Approve contract with Keefe Commissary Network, LLC., for inmate commissary services pursuant to Penal Code Section 4025 for a three year term of August 1, 2019 through June 30, 2022, with an automatic renewal for two (2), two-year extensions unless terminated by either party.

BACKGROUND/SUMMARY:
On June 25, 2019 your board approved the contract with Trinity Service Group for in-house food service for the jail and juvenile hall. Keefe Commissary Network is the sister company that will provide commissary service to the inmates at the county jail.
California Penal Code Section 4025(a) allows the Sheriff to establish, maintain and operate a store in connection with the jail. Inmates are allowed to purchase items such as postage, writing materials and snacks using money that they either came into custody with or from cashier checks / money orders received from family and friends. These funds are deposited into the Sheriff's Inmate Trust Account and used solely for this purpose. Upon release, the balance of the account is released to the inmate.
Section 4025(b) of the Penal Code provides prices for commissary items to be fixed by the Sheriff. Attached to this item is a sample of what is offered and the preliminary pricing that will be finalized upon contract approval. Commission of 31% will be received on commissary items with the exception of stamped envelopes and other items agreed to in writing by both parties to be sold at or near cost. Keefe offers Trinity Take-Out (TTO) which are items such as hamburger/cheeseburgers, sandwiches, pizza and desserts that are prepared fresh. Commission of 20% will be earned on the sale of these items. It should be noted that an inmate's ordering privileges for both commissary and TTO can be suspended for disciplinary reasons. Commission is deposited into the Inmate Welfare Fund with the county and expended for the benefit, education, and welfare of inmates.
The duration of this contract is consistent with that of Trinity Service Group, three year base contract with an automatic renewal for two (2) two-year extensions unless terminated by either party.
