BACKGROUND/SUMMARY:
On April 2, 2019 staff was directed to bring the Veterans' Memorial Park item to the Board for discussion. The County received concerns from constituents regarding foul smell and sanitary condition of the Vets park restrooms next to the Adult baseball field. The City of Hollister is in charge of locking and securing the restrooms facilities following program and events. County staff pressure washed the restrooms to address concerns. The administration did a site inspection, and bathrooms appear to be clean and sanitary condition.
The County of San Benito recognizes the advantages the community receives by having a location for youth to play sports. The County has partnered with multiple non-profits and the City of Hollister to encourage the use of facilities and public fields at Veterans’ Memorial Park for organized sports for the youth. The County holds agreements for the use of the fields with the following organizations:
1. Hollister Heat,
2. Babe Ruth,
3. Hollister Little League,
4. Hollister Tremors, and
5. The City of Hollister.
Also, the County has a Lease Agreement with the City of Hollister for the Skate Park at Veteran’s Memorial Park.
The Agreements between the four non-profits and the County have an automatic renewal for successive one year periods beginning on February 1 to January 31 with a 60-day notice written notice agreement termination cause. The agreement is subject solely to the fields at Veterans’ Memorial Park. The organizations are subject to the terms as described in attached agreements. See Terms of Use for details. The following is a summary of terms:
- Organization to schedule games with the County, at least three weeks before the events.
- The organization is responsible for utility incurred at the field for youth sports.
- The organization will keep the premise clean and sanitary.
- Organization to maintain the grounds including mowing, fertilizing, and irrigation during the particular sports reason.
Also, the delegation of duties is prohibited, without written consent from the County.
The County and City have had an extended standing operating agreement for the use of softball fields for the City’s Recreation programs. A copy of the operating agreement is attached. The City provides sanitary sewer and water to the park at no charge for the purpose of maintaining the fields. The City shall open all restrooms within the premises and lock and secure restrooms following such events. The City is responsible for repair of any damages to the restrooms caused as a result of the City’s failure to secure the restrooms.
