Approve Memorandum of Understanding Between County of San Benito and San Benito County Community Corrections Partnership (CCP) to fund the Jail Construction Project under SB81.

BACKGROUND/SUMMARY:
On June 5, 2017, the San Benito County Community Corrections Partnership Executive Committee (CCP-EX) voted that in the event the County requires and obtains a loan/additional funding in the amount up to $5M in order to fund the Jail Expansion construction project under SB81, the CCP commits to allocate the amount of $250,000 per year from funding under AB109 for the period of 20 years towards repayment of the loan.
The CCP shall not be obligated to allocate funds towards repayment should the loan not be necessary or the Jail Expansion Project be terminated prior to construction.
The term shall be in effect from July 1, 2017, or one year from when the additional funding/loan is obtained, whichever is later, until the repayment of the loan. No repayments or transfers of funds from AB109 sub-account shall occur until such time as the County secures the loan as indicated above.
This MOU memorializes the understanding between the parties regarding the annual funding of $250,000 per year.
