BACKGROUND/SUMMARY:

The County is in need of qualified professional services for administrative hearings pertaining to, but not limited to, Animal Control, building, cannabis cultivation, cannabis abatement, business license suspension or revocations, nuisance property abatement, dangerous or substandard buildings, mobile home rent control, cost confirmation lien hearings, administrative citations and penalties, vehicle abatement, dangerous or vicious animals, animal control, public works bid protests, zoning, waste management, contract disputes, personnel disciplinary actions, and general nuisance abatement, code enforcement, land use, public nuisances and zoning pursuant to Chapters 1.03, 1.04, 1.06, 11.15 and 13.01 of the San Benito County Code. 

Previously, hearing officer services were provided by the University of Pacific McGeorge School of Law. In October 2018, the County was notified that the University will no longer be providing this service. Subsequently, the University's Hearing Officer Program staff created their own company (California Hearing Officers, LLP), providing Hearing Officer services. This contract is a non-exclusive agreement to use California Hearing Officers, LLP on an as-needed basis. The RMA department anticipates there will be no more than 25 hearings in the next year.   

The Board is hereby requested to appoint the California Hearing Officers, LLP to serve as a County Hearing Officer for San Benito County.
