Review Land Conservation Act requests for Divisions (LCA Contract No. 69-034 - Las Aguilas Corp., LCA Contract No. 74-39 - Shingai, LCA Contract Nos. 11-02 & 11-03 - The Wine Group, LCA Contract Nos. 68-50 & 1973 Enlargement - Tobias Trust/Partnership), Compatible Use Determinations (LCA Contract No. 68-113 for a compost facility - D & D Brigantino (withdrawn), LCA Contract No. 71-059 for Event Center uses - Lone Tree Ranch, and LCA Contract #69-034 for Event Center uses - Las Aguilas Corp.), and Lot Line Adjustments (LCA Contract #68-100 - Asellus-Benito LLC), and make determinations approving or denying each request.

The Board of Supervisors is required to review Land Conservation Act applications under San Benito County Code Chapter 19.01 and Sections 51200 - 51298 of the California Government Code, and make a determination of either approving or denying the requests. The Board is the governing Agency relative to all Land Conservation Act applications. The Agricultural Preserve Advisory Committee is appointed by the Board to review and make recommendations on the applications prior to the public hearing before the Board. The Committee's action is only one of recommendation and the Board is responsible for the final judgment as to each application. The Board also has the responsibility to make sure its decisions conform to Chapter 19.01 of the County Code and Government Code Sections 51200 - 51298.

The Agricultural Preserve Advisory Committee met on November 1, 2018 and made recommendations regarding the requests currently set for hearing before the Board of Supervisors. See the attached Agenda, Staff Report and Agricultural Preserve Advisory Committee Meeting Minutes for detailed information about each request. Copies of the relevant provisions of Chapter 19.01 of the County Code and Government Code Sections 51200 - 51298 also are included in the packet.

The Agricultural Preserve Advisory Committee recommends the Board of Supervisors conduct a public hearing, review and consider each of the attached applications and the Committee's minutes and recommendations, and make determinations approving or denying each request.
