BACKGROUND/SUMMARY:

The County Counsel's office recommends that the Board consider the establishing fees for the County Counsel's office when outside counsel are used.  Outside counsel are normally used in the larger planning projects. Normally this expenses has been covered by reimbursement agreements negotiated on a case by case basis.  Under the new fee structure, an applicant would be subject to the new fees even if a reimbursement agreement is not in place.  However, the County may still determine to enter into a reimbursement agreement on a case by case basis. 

 

A proposed ordinance is attached for the Board’s review and consideration establishing fees to recoup the costs for the services provided.

 

The fees are based on the actual costs of services, no more and no less.  The proposed fees will provide a means to collect actual costs incurred by the County.

1.      Hold Public Hearing.

2.      Read title of the ordinance for the record, “An Ordinance of the County of San Benito Amending Article III, "Fees for County Services" of Chapter 5.01 "County Fees" of Title 5 of the San Benito County Code, by the Addition of Subarticle IX "County Counsel".

3.     Make a motion to (1) Accept introduction, waive further reading of the ordinance, and continue the matter to July 24, 2018, for adoption.
