  1. Approve and authorize the Chair to sign Professional Services Agreement with Denise Duffy & Associates, Inc., in an amount not to exceed $26,904.00 for the performance of preparing an initial study under the California Environmental Quality Act (CEQA) for a subdivision (TSM 09-82) of a 37.43-acre parcel into six parcels plus one remainder lot at 240 Cole Road, near Aromas. Approval of this agreement is contingent upon the execution of a reimbursement agreement by the project applicant; and

  2. Approve and authorize the Chair to sign Reimbursement Agreement with the BYPASS TRUST UNDER THE ROTH FAMILY LIVING TRUST (“project applicant”) for full reimbursement of County costs related to a pending project application, specifically for the preparation of an initial study.

BACKGROUND/SUMMARY:

RMA is reviewing an application for TSM 09-82, a tentative subdivision map at 240 Cole Road, on a 37.43-acre lot proposed for six parcels and one remainder parcel.  A request for proposals (RFP) was sent out to receive services for preparing an initial study under CEQA for this project.  In response, three proposals arrived from which RMA determined Denise Duffy & Associates (DD&A) was the best qualified environmental consultant for this activity.  A contract signed by DD&A is attached and includes a work program to prepare the initial study. The cost of the work is $26,904. The project applicant has agreed to the attached reimbursement agreement to fund this amount in full.

 

This reimbursement agreement is submitted so that the County fully recovers its costs (internal and external) spent processing this pending application.  Entering into a reimbursement agreement does not obligate the County to approve any given project.

It is recommended that the Board of Supervisors:

 

  1.
