BACKGROUND/SUMMARY:
TSM 14-91 (Tract No. 342) commonly known as Sunnyside Estates located at North and West of the intersection of Hospital Road and Southside Road was conditionally approved by the Planning Commission on May 18, 2016.
Section 23.09.008 of the San Benito County Code requires that a Final Map be submitted to the Board of Supervisors for approval after it has been approved by the County Engineer for complying with the approved or conditionally approved Tentative Map. The County Engineer and the Director of Planning Division have confirmed that the applicant has met the conditions of approval of the tentative map, as reflected in the Approval Notice and has bonded the required subdivision improvements except condition #9 re-Community Financing District (CFD). The developer has met the basic requirements of Condition #9 by requesting formation of a CFD and cooperating with the County staff in the formation process. County staff is reviewing necessary information to ensure fiscal neutrality to fully implement condition #9. Meanwhile the applicant has agreed to defer request of any Certificate of Occupancy until CFD is formed. The Final Map is being submitted herewith for the Board's consideration. Following Board's approval, the Final Map will be recorded with the San Benito County Recorder's Office.

It is recommended that the Board of Supervisors:
- Accept the attached Final Map for TSM 14-91, Tract No. 342,
- Accept on behalf of the public the offers of dedications for public uses in conformity with terms of the offer of dedication, subject to condition that the County of San Benito is not responsible or liable for any cost or expense of any offer accepted unless authorized by separate action of the Board of Supervisors,
- Authorize Clerk of the Board to sign the Final Map, after all required map signatures have been obtained, and
- Authorize staff to record the Final Map.
