BACKGROUND/SUMMARY:

Assembly Bill 1912 – has been introduced by Assemblyman Freddie Rodriguez, who is the chairman of the Assembly Committee on Public Employees, Retirement, and Social Security.

 

This bill would eliminate the Joint Exercise of Powers Act (JPA) provisions for community choice aggregators that permit an agreement between one or more parties to specify the responsibility for debts, liabilities, and obligations, and that permit the JPA to separately contract for those debts, liabilities, or obligations. The bill’s intent is to address JPA obligations where the JPA participates in the CalPERS public retirement system, making all parties, both current and former to the agreement, jointly and severally liable for all obligations to the CalPERS retirement system. This bill is intended to target liabilities and obligations for JPA’s who participate in the CalPERS retirement system.

 

If the bill is signed by the Governor, it would unnecessarily create a financial obligation for San Benito County member agencies.
