Approval of two contracts with Biggs Cardosa Associates Inc., one for the Rosa Morada Road Bridge Replacement Project in the amount of $365,892.70 and one for the Union Road Bridge Replacement Project in the amount of $1,001,450.50 for the period of January 1, 2013 through June 30, 2022, to pay for previous and future engineering, design, and environmental services. Neither contract has an impact on the General Fund.

BACKGROUND/SUMMARY:

Rosa Morada Road Bridge Replacement Project:

 

On December 11, 2006, the Board of Supervisors approved replacement of the Rosa Morada Road Bridge due to severe erosion, or scouring, surrounding the bridge footing.  Following a comprehensive selection process mandated by the Caltrans Local Assistance Procedure Manual, Biggs Cardosa Associates Inc. was selected to provide engineering, design, and environmental services for the project.

 

On May 24, 2011, the County entered into a contract with Biggs Cardosa Associates Inc. to provide engineering services for the Rosa Morada Road Bridge replacement project. 

 

As it pertains to Original Contract #1, the County has expended $487,857.58 of the approved contract amount of $538,104.00, and been reimbursed by the Federal Highway Administration (FHWA) $304,841.61. It is anticipated that the balance will be reimbursed in February, which amounts to $0.00 in net county cost.

On November 20, 2018, RMA Director Guertin provided an overview of the county bridge replacement program to the Board of Supervisors.  As part of the presentation, Director Guertin explained that due to this project being stopped before completion that there are costs totaling $318,248.00 associated with restarting and completing the Preliminary Engineering portion of the project.  In addition, the Contractor was instructed to work on the project after the initial contract expired dating back to September 2014. There are unpaid invoices due to Biggs Cardosa Associates Inc. in the amount of $47,644.70. 

As it pertains to the contract before you today, Original Contract #2, the County intends to expend $365,892.70. Of this amount the County will be reimbursed by FHWA $198,240.00 and the balance of the contract will be paid with Regional Surface Transportation Program funds.  Therefore, there is no impact to the General Fund.

Union Road Bridge Replacement Project:

 

On December 11, 2006, the Board of Supervisors approved replacement of the Union Road Bridge due to severe erosion, or scouring, surrounding the bridge footing.  Following a comprehensive selection process mandated by the Caltrans Local Assistance Procedure Manual, Biggs Cardosa Associates Inc. was selected to provide engineering, design, and environmental services for the project.

 

On December 16, 2008, the County entered into a contract with Biggs Cardosa Associates Inc. to provide engineering services for the Union Road Bridge replacement project.

On May 31, 2017 County Resource Management Agency (RMA) staff terminated Original Contract #2 because the contract did not go through the public bidding process. On April 11, 2017 the Board of Supervisors approved a resolution that 1) found that it was in the public’s best interest to continue using the services of Biggs Cardosa Associates Inc., and 2) directed the RMA Director to negotiate and enter into a new contract with Biggs Cardosa Associates Inc. to continue providing professional engineering services until the project is complete.

As it pertains to Original Contract #1, the County has expended $2,809,496.25 of the approved contract amount of $2,821,890.00, and been reimbursed by the Federal Highway Administration (FHWA) $2,498,219.21, which amounts to $323,670.79 in net county cost.

As it pertains to Original Contract #2, the County expended $0.00 of the approved contract amount of $831,850.00.  This contract is terminated to none of these funds will be expended.

On November 20, 2018, RMA Director Guertin provided an overview of the county bridge replacement program to the Board of Supervisors.  As part of the presentation, Director Guertin explained that due to this project being stopped before completion that there are costs totaling $679,000.00 associated with restarting and completing the Preliminary Engineering portion of the project.  In addition, due to the poor management of this project by County staff combined with the gaps in time between contracts it has been found that there is $322,450.50 in unpaid invoices due to Biggs Cardosa Associates Inc. dating back to January 2013. 

As it pertains to the contract before you today, Original Contract #3, the County intends to expend $1,001,450.50. Of this amount the County will be reimbursed by FHWA $250,819.00 and the balance of the contract will be paid with Regional Surface Transportation Program funds.  Therefore, there is no impact to the General Fund.

STAFF RECOMMENDATION:

1. Approve two contracts with Biggs Cardosa Associates Inc., one for the Rosa Morada Road Bridge Replacement Project in the amount of $365,892.70 and one for the Union Road Bridge Replacement Project in the amount of $1,001,450.50 for the period of January 1, 2013 through June 30, 2022, to pay for previous and future engineering, design, and environmental services.

 

2. Authorize the RMA Director to extend the contract for an additional two-year period if necessary and approve change orders up to 10% of the contract amount.
