BACKGROUND/SUMMARY:
The Sheriff's Office is requesting authorization to enter into an amended agreement with Global Tel*Link (GTL), provider of inmate phone services, to revise provisions in both the original agreement entered into on July 6, 2009 and Amendment #1 signed June 14, 2016 stemming from an order from the FCC mandating rates and charges for inmate telephone services and certain transaction fees. Amendment #2 provides the following changes and additions:
Changes
Increase Intrastate Inmate Telephone Services (ITS) calls to $0.30 per minute from $0.24, an increase of $0.06. This increase follows the ruling by the U.S. Court of Appeals that the FCC lacked authority to set rates for calls between inmates and people in the same state.
Commission paid to the Sheriff's Office from ITS intrastate calls is increased to $0.08 on completed billable calls, an increase of $0.06. This commission is deposited into the Inmate Welfare Fund pursuant to Penal Code Section 4025(d).
The term of this agreement will extend an additional three (3) years, to 2021 from 2018 with an automatic renewal for two (2) additional one (1) year terms unless either party notifies their intention not to renew.
Replacements and Upgrades
Under this amendment GTL, at no cost to County, will replace telephones located in the housing units and visitation area. The telephone system will be upgraded to the ICMv inmate telephone platform which will enhance technological aspects of this system.
New Equipment / Services
GTL, at no cost to County, will provide a total of fourteen (14) Flex Kiosks within the facility, which includes the jail expansion area upon completion. This equipment will allow Video Relay Service for the deaf or hearing impaired inmates, video visitation and messaging between the inmate and family.
GTL will collect charges for the use of the Flex Kiosk. Telephone rates will be charged at the same $0.30 per-minute stated above. On-site video visitation will not incur a charge; however, remote video visits will be charged at the rate of $10 for 25 minutes. Messaging will be charged at $0.25 per Message Credit as described in section 7(e) of the amended agreement.
Commission on video visits is twenty percent (20%) of gross payments collected and will be deposited into the Sheriff's Inmate Welfare Fund.
Financial Consideration
Increase in call rate and commission will increase the annual revenue to the Inmate Welfare Fund by approximately $5,000 for an estimated annual total of $13,500. At this time commission from video visitation is unknown as this is a new service. Revenue is used to offset non-mandated expenditures for the benefit, education and welfare of the inmates and said use is reported to the Board of Supervisors at the end of each fiscal year pursuant to Penal Code Section 4025(e).
Section 4, Company Provided Equipment, Services and Cabling, states, "Premise Provider will supply and install all required wiring and cabling in accordance with Company specifications." There will be no additional wiring or cabling needed in the old facility and the cost for the new wing has been included in the construction cost.
