BACKGROUND/SUMMARY:

PROJECT DESCRIPTION:  In accordance with the Subdivision Map Act and the San Benito County Zoning Ordinance, the applicant has requested six (6) Certificates of Compliance. Each Certificate will memorialize the legal creation of the separate parcels. The Certificates are requested for estate planning purposes. 

STAFF ANALYSIS: The applicant submitted copious records for staff’s review. These records included Patents, Deeds, and detailed final accounts of estate settlement. Utilizing these documents staff was able to verify that the applicant is entitled to six (6) separate Certificates of Compliance. The parcels were legally created in the following manner:

Parcel 2 (APN 025-014-003) Created by Patent- located at Book 8 of Patents page 252

Parcel 3 (APN 025-014-014) Created by Patent located at 94-03129 O.R.

Parcel 4 (APN 025-014-005) Created by Patent #7703 and transferred separately by Deed- Volume 278 Page 271 O.R.

Parcel 5 (APN 025-014-003) Created by Patent- Book 3 of Patents at Page 436

Parcel 6 (APN 025-014-009) Created by Patent- Book 2 of Patents at Page 186-187

ENVIRONMENTAL EVALUATION: The proposed project can be found exempt from environmental review pursuant to CEQA Guidelines Section 15061(b)(3). The activity is covered by the general rule which exempts activities that can be seen with certainty to have no possibility for causing a significant effect on the environment.

STAFF RECOMMENDATION:

Staff recommends that the Planning Commission find the project Categorically Exempt from CEQA review, adopt the Notice of Exemption as attached, and approve the project as proposed in accordance with the findings and evidence contained herein, subject to the conditions of approval as indicated.
