1) First reading and motion to accept introduction, waive further reading of the ordinance, and continue the matter to October 11, 2016, at 10:00 a.m. for adoption of the proposed ordinance amending Ordinance No. 828, regarding compensation for the Board of Supervisors of San Benito County, to establish that the Board of Supervisors shall be paid special compensation in the same manner as Elected Department Heads.

BACKGROUND/SUMMARY:
Historically, the Board of Supervisors has received cash in lieu of benefits in the same manner of other County employees, most specifically elected Department Heads. For example, Board members, like other employees, receive a $150.00 monthly stipend for those members of the Board that do not participate in County's Health Insurance. Section 5 of Ordinance 828, adopted in 2008, states:
"Benefits shall be authorized for members of the Board of Supervisors in the same manner and to the same extent as they are generally authorized for department heads in County service."
The Auditor's Office has asked that Ordinance 828 be amended to clarify this technical point, as cash in lieu of benefits, for example, can be characterized as "special compensation."
This ordinance memorializes the compensation historically provided to the Board of Supervisors, and would, in the future, clarify that the Board of Supervisors will receive such special compensation as provided to elected department heads.
