BACKGROUND/SUMMARY:

Staff has researched State Contracts (CMAS) Agreements for the purchase of one 2016 motor grader as approved in the FY 2016-17 adopted budget. CMAS Agreements serve as a time and resource savings mechanism in the competitive purchasing process required of non-profit, education and local governments.  The State of California conducts a competitive bidding process, resulting in award of CMAS Agreements, and therefore satisfy competitive bidding requirements while obtaining nationally leveraged and aggregated pricing for use by organizations such as ours.  Staff recommends the issuance of a purchase order to Pape' Machinery of Gilroy, based on CMAS Contract Number 4-08-23-0022A, for the purchase of one (1) John Deere 670G Motor Grader for $320,170.59.

STAFF RECOMMENDATION:

It is respectfully recommended that the Board of Supervisors:

1. Find that competitive bidding would not be in the public interest because bidding process associated with the State CMAS Agreements satisfy County purchasing requirements, and it would be unnecessarily costly for the County to go through its own competitive bidding process when the State of California has already done so;

2. Approve purchase order to Pape' Machinery of Gilroy for one 2016 John Deere 670G Motor Grader using State Contract (CMAS) Number 4-08-23-0022A, not to exceed $320,170,59; and

3.   Authorize the RMA Director to sign the purchase order and any other documents necessary to complete the purchase, subject to County Counsel's approval.
