Purchase of Property at 1161 San Felipe Road for Community Services Center.  Board action, includes but is not limited to: finding acquisition is Categorically Exempt from CEQA under Class 32 Infill Development;  adopting Resolution approving the executed Real Property Purchase Agreement and accepting the Grant Deed; and approving loan of $1,000,000.00 from the Health and Human Services Agency (HHSA), fund 221, to Capital Projects, fund 300, as reflected in the Budget Adjustment/Transfer form, and direction to staff.

BACKGROUND/SUMMARY:

On December 3, 2015, the Board directed staff to proceed with due diligence and negotiations for potential purchase of property at 1161 San Felipe Road for the purpose of operating a Community Services Center. The proposed use would consist of an overnight shelter for up to 50 displaced persons and counseling, job training, and related services during the day.

 

The interior of the existing building would be remodeled to accommodate the proposed uses. Only minor cosmetic changes to the exterior and site (cleanup, painting, etc.) are contemplated. Acquisition and construction will be funded through a CDBG grant already awarded to the County.  However, the funding of the purchase will need to be accomplished through an interfund loan from the Health and Human Services Agency (HHSA), fund 221, to Capital Projects, fund 300.  The final expenditure will subsequently be transferred to HHSA and claimed for reimbursement from the CDBG award.  The necessary budget adjustment form is attached for your approval and includes comments from the Auditor regarding the transaction.

 

The property was annexed into the City of Hollister in 2015 and is subject to their planning and zoning requirements. City staff has indicated that the use of the property for the intended purpose is consistent with both the General Plan designation and the applicable M-1 zoning. The County will apply for a conditional use permit, in accordance with City zoning requirements.

 

The project is exempt from CEQA under Categorical Exemption 32 Infill Development.

STAFF RECOMMENDATION:

It is respectfully recommended that the Board of Supervisors:

1.     Find that, based on all of the evidence in the record, the acquisition of the property at 1161 San Felipe Road is Categorically Exempt from CEQA under Class 32 Infill Development and that none of the section 15300.2 Exceptions are applicable;

2.     Adopt Resolution, approving the executed Real Property Purchase Agreement and accepting the executed Grant Deed;

3.     Authorize the Chair to sign the Resolution, Real Property Purchase Agreement and Certificate of Acceptance and Consent to Record the Grant Deed;

4.     Approve an inter fund loan of $1,000,000.00 from the Health and Human Services Agency (HHSA), fund 221, to Capital Projects, fund 300, as reflected in the Budget Adjustment/Transfer form; 

5.     Direct staff to file the Notice of Exemption, and to process and record the executed documents through escrow, in a manner mutually acceptable to both the seller and the County; and

6.     Direct staff to process an application with the City of Hollister for a conditional use permit for a Community Services Center.
