Approve legal services agreement with Miller Starr Regalia for legal services performed pertaining to the Bluffs project and related entitlements, in an amount not to exceed $197,500 and authorize County Counsel to sign a Conflict Waiver Letter, waiving any actual or potential conflict of interest due to Miller Starr Regalia's representation of Mr. Bates and Mr. Stringer in other land use development matters.

BACKGROUND/SUMMARY:
Counsel requests that the Board approve a legal services agreement with the law firm of Miller Starr Regalia, for legal services related to the Bluffs project and related entitlements, in an amount not to exceed $197,500. The cost of the legal services will be reimbursed by the developer under an existing reimbursement agreement. The proposed agreement was provided to the applicant for review and the proposed scope and budget was acceptable.
Counsel also requests that the Board approve the conflict waiver letter as the law firm Miller Starr Regalia has performed prior legal work for applicants, as well as expensive legal work for the County.

STAFF RECOMMENDATION:
It is recommended that the Board of Supervisors:
1. Approve the legal services agreement with the law firm of Miller Starr Regalia, in an amount not to exceed $197,500, for legal services related to the Bluffs Project; and
2. Authorize the Board Chair to sign the agreement.
3. Approve and authorize the County Counsel's office to execute the conflict waiver letter.
